Formulating an insurance claim is complex and very time-consuming. The onus is on the claimant to formulate and justify any claim. We guide the client through the claims process, motivate the claim under the policy, quantify the loss appropriately, assist with the gathering of necessary information that supports the claim motivation and quantification, and engage with the Insurer representatives.

COVID-19 Impact

The economic fallout of this pandemic is devastating to all areas of the economy, leaving virtually no business untouched. And with Insurers providing little to no latitude on COVID-19-related Business Interruption claims, the claims process has become more onerous than ever and represents the highest of stakes.

Although each matter is unique (as all business interruption losses are) and should be viewed on its own merits, we believe that many commercial policies include an element of cover for such circumstances and there is generally merit in pursuing an insurance claim for losses suffered.

ICA Response Strategy

Through our experience, we have anticipated the various technical defences that are likely to be raised by Insurers on both the merits of the loss and the quantum, and have established appropriate responses.

We have a broad client base that includes businesses from a variety of industry sectors, and we have seen that there are numerous policy wordings that may respond to varying degrees. As a result, we are well-positioned to establish an appropriate strategy for a client in a particular industry sector with a particular policy wording.

We hold strong views on how policies and Insurers should be responding.
